iFlyChat is a product of iFlyLabs.
The following are the terms and conditions for using the iFlychat website (iFlyChat.com) and iFlyChat Services. By accepting the terms and condition and/or by using the iFlyChat service you are accepting to be bound by all the terms and conditions.
1. Description of Services
iFlyChat offers a Free Trial, a Free Account and various other premium plans which comes with various features and lmitations. Free Trial is of 14-days, Free account is for unlimited time period. iFlyChat reserves the right to terminate Free account if at all change in policy is introduced, users will be intimated well in advance in such scenario. iFlyChat can also change fee structure at any period of time, it may or may not affect exisiting customers.
2. Registration Data and Privacy
In order to access some of the services on this site, you will be required to use an account and password that can be obtained by completing our online registration form, which requests certain information and data By registering, you agree that all information provided in the Registration Data is true and accurate and that you will maintain and update this information as required in order to keep it current, complete, and accurate. You yourself are responsible for safeguarding your username/password provided to you by iFlyChat for logging in our site. iFlyChat will not be responsible for the loss of password and any intrusion in your account becauee of that.
3. Conduct on Site
Your use of the site is subject to all applicable laws and regulations, and you are solely responsible for the substance of your communications through the site. By posting information in or otherwise using any communications service, chat room, message board, forum, or other interactive service that may be available to you on or through this site, you agree that you will not upload, share, post, or otherwise distribute or facilitate distribution of any content that is unlawful, contains virus, which infriges copyright or porn You agree that we may at any time, and at our sole discretion, terminate your membership, account, or other affiliation with our site without prior notice to you for violating any of the above provisions.

5. Intellectual Property Information
The Service, which includes but is not limited to all intellectually property rights in the iFlyChat Service, will always be the property of iFlyChat and iFlyLabs. You may use the Service subject to acceptance of the terms of this Agreement. You will not, nor will you, allow any third party to reverse engineer and/or create derivatives of the iFlyChat, using any method possible.You will not, nor will you, allow any third party to modify the iFlyChat in any way.
6. Disclaimer or Warranties
iFlyChat is provided ‘as is’. iFlyChat and its contractors hereby disclaim all warranties of any kind, expressed or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement. Neither iFlyChat nor its contractors makes any warranty that the Client, Service, or website will be error free, free of viruses or other harmful components, or that access thereto will be continuous or uninterrupted. You understand that the use of iFlyChat, and the website is at your own discretion and risk.
7. Limitation of Liability
In no event shall iFlyChat, iFlyLabs or our affiliates be liable to you or any third party for any special, punitive, incidental, indirect or consequential damages of any kind, or any damages whatsoever, including, without limitation, those resulting from loss of use, data or profits, whether or not we have been advised of the possibility of such damages, and on any theory of liability, arising out of or in connection with the use of this site or iFlyChat Services of any web site referenced or linked to from this site.
iFlyLabs's and its contractors' total cumulative liability to you or any other party for any loss or damages resulting from any claims, demands, or actions arising out of or relating to this Agreement shall not exceed $1.
8. Indemnification
You agree to defend, indemnify, and hold us and our Affiliates harmless from all liabilities, claims, and expenses, including attorneys fees, that arise from your use or misuse of this site. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.
9. Termination of Use
You agree that we may, in our sole discretion, terminate or suspend your access to all or part of the site or iFlyChat Service with or without notice and for any reason, including, without limitation, breach of these Terms of Use. Any suspected fraudulent, abusive or illegal activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. Upon termination or suspension, regardless of the reasons therefore, your right to use the services available on this site immediately ceases, and you acknowledge and agree that we may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or this site. We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension or any other actions taken by us in connection with such termination or suspension.
10. Governing Law
iFlyChat and its site is provided by iFlyLabs and are controlled from our office in New Delhi, India. Any dispute arising between iFlyLabs and you due to violation of this agreement or any other reason whatsoever, will be be under the jurisdiction of courts in New Delhi, India. In the event of any conflicts between foreign law, rules, and regulations, and Indian law, rules, and regulations, Indian law, rules, and regulations shall prevail and govern. Each party agrees to submit to the exclusive and personal jurisdiction of the courts located in New Delhi, India. The United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transactions Act shall not apply to this Agreement.
11. Refund Policy
We do not offer any refund. This is due to the fact that we offer a Free Trial Period before you actually start paying for our services. You should fully check your needs in this trial period and then only subscribe to the paid plans.
12. Miscellaneous
All notices to a party shall be in writing and shall be made either via email or conventional mail. Notices to us must be sent to the attention of Customer Service at complaint@iflychat.com, if by email, or at iFlyChat support@iflychat.com if by conventional mail. Notices to you may be sent to the address supplied by you as part of your Registration Data. In addition, we may broadcast notices or messages through the site to inform you of changes to the site and services, and such broadcasts shall constitute notice to you at the time of sending.
You agree not to sell, resell, reproduce, duplicate, copy or use for any commercial purposes any portion of this site, or use of or access to this site. We shall be excused from liability for disruption or delay in iFlyChat, arising from any event beyond our reasonable control, whether or not foreseeable by iFlyLabs. All the services, except as explicitly noted on this site, available through this site are offered by iFlyLabs.
